ADCET was proud to host this webinar by Elizabeth Dickson (Senior Lecturer, Law School, Queensland University of Technology) who provided a refresher on the Disability Discrimination Act and Disability Standards for Education as they apply to the tertiary sector of education in Australia. Disability Standards for Education: Information products for students with disability and their parents and carers
The Australian Government Department of Education (Department) worked with Children and Young People with Disability Australia (CYDA) and students with disability and their families and caregivers to create these resources. They aim to help you understand your rights as a student with disability, or the rights of your child, and to work with education providers to make sure you can learn and participate on the same basis as students without disability.
- How to advocate - helps school and tertiary students with disabilities to build self-advocacy skills and provides guidance on how to raise and resolve concerns with education providers.
- Explaining the Disability Standards for Education – this resource outlines what the Standards are and what they are designed to do.
- Milestones and Transitions – this resource is to help students and their parents and caregivers make their way through their education journey.
- Disability Standards for Education in Practice: Action Plan – this resource is for students who are in high school or tertiary education.

Three decades of misrecognition: defining people with disability in Australian higher education policy
In Australia, the Disability Discrimination Act and associated Educational Standards prevent educational institutions from treating people with disability less favourably than those without disability – directly or indirectly. However, people with disability are still subject to both economic and cultural disadvantage in Australian higher education policy. Drawing on three stages of development of Australian higher education equity policy across three decades of higher education disability policy, the article provides insights into how people with disability have been categorised, classified and counted in higher education and the implications this has for how they are supported. Fact Sheet for RTOs: Providing quality training and assessment services to students with disabilities
Nearly one in five Australians has a disability. This includes physical and learning disabilities, chronic medical condition or mental illness. People with disabilities have a right to access and participate in education and training. Registered training organisations are required to comply with the Standards for Registered Training Organisations (RTOs) 2015, the Disability Discrimination Act 1992 (DDA), and the Disability Standards for Education 2005 when providing services for students who may have a disability. This fact sheet aims to help RTOs understand their obligations under the Standards and other relevant legislation.

AHRC: DDA guide - Getting an education
Information from the Australian Human Rights Commission outlining how he DDA makes it against the law for an educational authority to discriminate against someone because that person has a disability. This includes all public and private educational institutions, primary and secondary schools, and tertiary institutions such as TAFE, private colleges and universities.

Using Disability Discrimination Law in NSW
This booklet maybe useful as a starting point. It explains what disability discrimination is, understand how the law might apply to you, it also explains some of the differences between New South Wales and Federal laws. It may also be a useful resource for advocates and legal practitioners who want to assist clients who are experiencing disability discrimination.
